IMPORTANT: INFORMATION FOR PROSPECTIVE TENANT(S)

         This Notice informs you as a prospective tenant(s) that the tenancy being offered by the prospective landlord(s) is a short assured tenancy under Section 32 of the Housing (Scotland) Act 1988.

Note 1 To prospective tenant

 

If you agree to take up the tenancy after your landlord has served this notice on you, your tenancy will be a short assured tenancy. You should keep this notice in a safe place along with the written document setting out. The terms of tenancy which your landlord must provide under section 30 of the housing

(Scotland) ACT 1988 once the terms are agreed.

 

Note 2 To prospective tenant

 

If you require further guidance on assured and short assured tenancies, consult a solicitor or any organization which gives advice on housing matters.

In signing this declaration I acknowledge that I have been given a copy of the preceding attached pages known as Form AT5 and understand that the tenancy being offered by you is a short assured tenancy under Section 32 of the Housing (Scotland) Act 1988.

Agreement for the retention (and possible use) of keys by landlord

AGREEMENT

 

The tenant is not obligated to accept any part of this agreement and may refuse the landlord permission to retain a set of keys for the property.

 

The tenant may refuse to accept any part of the agreement by deleting the appropriate section in the agreement.

 

If the tenant refuses to sign the agreement or any part of the agreement it will in no way affect the tenancy or the tenants’ rights.

 

 

Please note that the tenant will be responsible for any costs of reinstatement or repair arising from lost keys or changed locks, and will be required to return or reinstate all keys or original locks at the end of the tenancy.

 

 

I agree that landlord wenxing wang can keep possession of a set of keys for the above address.

 

I give permission for the keys to be kept or used in the following circumstances.

 

In the presence of the tenant (e.g. where the tenant's keys have been lost or mislaid).

 

For the landlord to enter the property carry out repairs only with the express written permission of the tent.

 

For the landlord to enter the property carry out an inspection of the property only with the express written permission of the tent.

 

Return of deposit

         a) No deposit will be refunded should the tenant leave during the duration of the lease. In addition the Landlord will pursue the tenant through the courts if necessary for all outstanding rent due until the tenancy expiry.

         b) The deposit will be returned in full provided that all keys are returned, the property is fully cleaned to a professional standard as found, any damaged articles are replaced, all tenants belongings are removed, property is left in the same condition as found (fair wear and tear except d) and all put standing accounts (including council tax, where applicable) are settled in full. The tenant must not withhold and rent payments including the last month’s rent in lieu of the deposit.

           We will charge a minimum of 200.00 to clean a property of given back unclean.

         c) The deposit will only be returned provided that the tenant has given the required notice to the landlord stating their intention to leave. Tenant must notice landlord their intention to leave one month in advance or the deposit will not be refunded. Prohibitions of use and sub-letting

         d) The property will be used only as a private residence for the tenants.

         e) The tenants shall not assign this agreement in whole or in part nor sub-let or part with possession of the property in whole or in part without the knowledge and approval in writing of the landlord. Sub-letting without the permission of the landlord shall be in breach of contract and will automatically lead to the tenants having their lease terminated with full loss of deposit.

 

Inventory

         a) At commencement of the lease the tenant will be issued a completed inventory. It will be the tenant's responsibility to check the inventory and property over upon commencement of the lease to inform the landlord of any maintenance or decorative discrepancies not already accounted for in this document.

         b) It is the tenants responsibility to check whether items in the property during the viewing process are included as part of the lease.

            The landlord cannot accept any responsibility for replacing item belonging to the previous occupants that are removed from the property prior to the new tenants moving in.

 

Responsibilities of tenant

         a) The tenant accepts the property in its present state as being in a good and habitable condition and must not make further requests to the landlord for additional items. At the end of the tenancy, the tenant will be responsible for any damage (other than fair wear and tear) to the property including fixtures and fittings or damage to moveable item(s).

         b) Where applicable, the tenant accepts the garden and surrounding area in its current state and must not make any further demands on the landlord with regard to fencing, pathways, shrubbery, etc. It will be the responsibility of the tenant to maintain the garden to a reasonable standard and leave the garden in the same condition of upkeep that it was found in at the beginning of the tenancy.

         d) The use of illegal substances or the immoral/illegal use of the property is strictly prohibited and will result in immediate termination of the lease.

         e) Should the tenant know of any damage caused to the flat either maliciously or accidentally, they should let the landlord know immediately to avoid

            all tenants being held responsible for the costs of the repair.

         f) The tenant will be responsible for obtaining a television license for any television receiver used by them.(If the rent fee including the bill, tenant do not need to register.)

         g) It is the tenant's responsibility to ensure that all areas of the property and with particular regard to bath, shower and sink areas are kept clean during the term of the tenancy agreement. Tenant's who fail to keep these areas clean, including any grouting, will become liable for the costs involved in appointing an external contractor to clean these areas.

         h) The tenant agrees to keep the interior of the premises, the fixtures and fitting, and decoration in good condition and pay for any necessary repairs, required due to fault on their part. The tenant agree to pay the whole cost of repairing, replacing or redecorating any part of the property or its contents and furnishings which is required as a result of the tenants' breach of, or failure to fulfill or observe any of the conditions of this lease.

 

Council tax

         a) The rent in this lease agreement does not include council tax. The landlord takes no responsibility for any financial commitments in respect of the council tax irrespective of current or future legislation regarding this tax.

         b) Where council tax is applicable to the property, it is ultimately the responsibility of the new tenant to ensure that their new council tax account has been successfully changed into their name and is being paid from the lease start date.

 

Responsibilities of the landlord

         a) To pay all premiums for insurance of the building and contents belonging to him. The landlord, however, will have no responsibility for damage to or insurance of any furnishings, personal effects and contents brought into the property by the tenant who will be responsible for insuring the same.

         b) To maintain the building in a wind and watertight condition and for keeping in repair and proper working order and sanitary installations.

         c) To keep in repair the structure and exterior of the house including drains, gutters and external pipes.

         d) To keep in repair and proper working order installations for the supply of water, gas, electricity, sanitation, space heating.

         e) The tenant accepts that where damage has been caused to the property or mechanical breakdown out with the landlord's control, there will be no reduction in rent.

 

The tenant agrees to the following:

         a) The keep the property in a clean and tidy condition and properly aired at all times. The tenant is responsible for buying necessary cleaning tools.

         b) not to smoke in the property

         c) In the interest of neighbors and the property itself, the tenants agree not to cause noise or inconvenience to neighbors therefore not to use the washing machine, Hoover, play music after 9pm.

         d) The tenant is responsible for the replacement of fluorescent, low voltage and standard light bulbs.

         e) Not to keep animals without the express consent in writing of the landlord.

         f) The tenant agrees to allow the landlord access to the property to carry out viewings up to one month prior to the end of their tenancy.

         g) If tenant has signed the lease, tenant cannot ask for any discount on rent fee.

         h) Keys deposit, tenant needs to pay 10 pounds for the key deposit and it will be refunded after tenant return the keys.

         i) About short tenancy: If the tenancy is less than 3 months, tenant need to pay for rent fee together including 50 pounds and 10 pounds key deposit. the tenancy is less than one month, tenant should pay for one month. If the tenancy less than 7 days, pay for 1/4 rent fee; less than 15 days, pay for 1/2 rent fee.

         j) If someone visiting the tenant for more than 3 days, tenant need to pay for 15 pound per day.

         k) During the time of 9:00-23:00, tenants are not allowing download with emule, BT, qvod, pp-live etc.

         l) Landlord has provided the trap valve for the sink in kitten and bath room, so after using, tenant should clean the sink immediately. If the sink has been blocked tenant should to use sink-unblock the clean. If it doesn't work, tenant need to find special work to clean the sink, and it needs about 50 pounds.

SHORT ASSURED TENANCY

LEASE DETAILS

 

         a) The lease is starting from ___________________ until ______________________.

         b) The property will be let furnished. The tenant shall, at all times remain liable for rent, , council tax, telecom bills and any other communal service charges associated with the property, like stair cleaning and gardens maintenance. All factoring and maintenance fees are not included in the monthly rent.

         c) Should the landlord wish to terminate the lease one month notice should be given.

            Should the tenant wish to end the lease one month notice must be given in writing in the line with the lease dates. Without this notice the tenancy will continue to run on a month to month basis.

 

RENT AND DEPOSIT

 

         a) The rent will be _______ per Calendar month.(From October 1st to April1st 40 pounds bill for each tenant is included, From April 1st to October 1st 20 pounds bill for each tenant is included)

         b) The rent must be paid by one single standing order each month and should be received no later than the _______ of each month. Please note this condition will be strictly enforced.

            Failure to follow these instructions will be to generate late rent charges of 5 per day.

         c) A security deposit of ________ shall be paid upon entry and will be refunded two weeks after the lease has expired, minus any fair deductions.

         e) The rent will be reviewed every six months and may be subject to increase in line with inflation.

关于bill:如果是包bill的,则bill由甲方负责,如果是share bill的 则bill是室友平摊。如果是包bill,甲方负责电费,网费,煤气费,水免费。关于包bill 101日到41 每人每月包40bill 其他月份每人每月包20bill 如果超过这个范围,额外bill大家平摊, 往年经验只要外出时候关暖气, 关灯, 不要一件衣服就用洗衣机。 很难超过这个bill

关于转租:房屋只限乙方使用,乙方不得私自转租、改变使用性质或供非法用途。

租后讲价问题:乙方租前需认真比较可选择的房子的价格,乙方不得在租后以某某朋友租金比这里的便宜等为条件要求降价。如果乙方准备更换其他房子需在合同期满,提前一个月书面(包括电子邮件)告之甲方。(出租房是个很特殊的商品,它会随着供求而价格变化,所以不能用入住后一段时间市场上的价格和入住时候的价格比较,比如9月,6月都是房租最贵的时候)

押金问题 物品损坏,需要购买对应物品,否则从押金中扣除。 退房前要把房屋打扫干净,和入住时候一样干净,否则从押金中扣清理费。 对于签订定期合同的,如果提前走,可以转租给其他人, 如果没有找到人转租,空开的时间的房租需从押金里扣除。

钥匙押金:如果退房时候钥匙丢失,需要重新补配,否则从押金中扣掉30镑。

不足一个月的房租:比如合同签到9月10日,而9月1日准备离开,这种情况房租是要付到9月10日的,如果9月12日离开,这种情况要看房间是否租出去了,如果没租出去可以按天算 就是(月租除以30)x多出来的天数

朋友拜访 乙方如有朋友拜访过夜,需告之甲方,每月入住时间超过3 需缴纳每日15镑租金。(月份不累计,4个月没带朋友来过夜,第五个月也不能带朋友住15;

用电安全:如因乙方忘记关电暖气,微波炉等引发火灾,乙方需付全责。

关于吸烟:英国法律规定室内和楼道禁止吸烟,如果吸烟需要到楼外面,而不是屋子外面吸烟。

关于网路9:00am-23:00pm期间 乙方禁止用BT ,电驴,快播,pp-livep2p下载软件,否则会影响室友正常上网。

噪音问题:乙方关门时候要尽量轻些,不准用力跺脚,不准剁排骨,晚上9点以后 到早上9点前不要大声放音乐或和朋友大声说话 以免影响其他人休息。 如果因此引发楼下,邻居室友投诉,甲方会警告一次,如果再次投诉甲方可单方面解除合同,并且扣掉押金。 如果乙方室友不安静也可以找甲方投诉。

卫生问题:需按值日表每周轮流值日,保持一个好环境,值日细节见值日表。 甲方会定期检查卫生,检查不合格会要求重新清理,如果仍旧不合格可以雇佣清洁人员来清理,费用从押金里扣除。

个人物品:乙方妥善保管个人物品,如有丢失等甲方不负责赔偿

下水道堵塞:甲方提前准备好下水道滤网,乙方洗菜,洗澡时候不要移开滤网,洗完后及时清理残留在滤网里的污物。 这样通常不会堵塞。如果万一堵塞,乙方可以买通下水道的液体来处理,仍旧不行乙方需要找专业通下水道的工人大概50镑左右。

非人为损坏:电冰箱,洗衣机,烤箱等非人为损坏,由甲方负责维修和更换。 更换时甲方购买后会专人送货到门,约定送货时间乙方协助开门。 维修或更换在15个工作日内完成。如果人为损坏,需乙方负责购买或维修。

灯和清洁用品:关于灯泡和清洁用品,吸尘器由甲方提供,吸尘器里面的纸袋需要乙方负责购买。清洁消耗品由乙方负责,如果以后有损坏需要乙方自己购买, 入住时甲方确保卧室,厨房,卫生间,走廊每个房间至少有一盏灯是工作的,如果入住后有灯坏掉需要乙方自己购买安装。

未尽事宜 此合同未尽事宜,双方可协商解决,并作出补充条款,补充条款与本合同有同等效力。双方如果出现纠纷,先友好协商,协商不成的,由法院裁定。

其他注意事项

不要随便给陌生人开门:不要给随便给陌生人开门,有人敲门可以看看是不是快递,如果不是快递尽量不要开门,特别是自己在家的时候,虽然爱丁堡的治安很好,是治安十佳城市,但仍旧不排除有入室抢劫等事件发生的可能。

信息安全:不要随便把地址,生日,给别人,护照号和签证复印件就更要妥善保管,不要轻易相信中奖,卖东西时小心尼日利亚人购买。
